History. 4 of 4 cases. Three restarted after a higher court paused the ban, and Mexico after about 13 weeks under a new order.
Hunch. Judge Cardone found the people suing likely to win, and in Big Bend the border agency still lacks permission from many landowners, so a restart needs both a court win and land.
Resolves on Customs and Border Protection statements and reports in The Guardian and Reuters, checked on 2 January 2027: YES if Judge Cardone's order has been paused, lifted or overturned and building or ground work has restarted in the area it covers before 1 January 2027. If the order stands and no work has restarted, it resolves NO.
We looked for cases where a government was building under emergency or national security powers that set normal rules aside, work had started, and a judge then stopped it until the case was decided. We found four since 2022. Three are in the United States and two involve the Trump administration. The White House ballroom case of 2026 is the one the count rests on: without it there would be only three.
