History. 2 of 8 cases: the Supreme Court of India on day 13 and a Mexican appeal court on day 45. In both Kenyan cases no higher court lifted the order.
Hunch. By 3 October no report we found said the government or Dangote had appealed, and the order already let the opening ceremony go ahead, which leaves them little reason to rush to a higher court.
Resolves on Kenya Law (new.kenyalaw.org, Court of Appeal and Supreme Court), checked on 7 November 2026 at 10:00 UK time, with The Star, Pulse Kenya and People Daily as backup: YES if by 6 November 2026 the Court of Appeal or the Supreme Court of Kenya sets aside, suspends or narrows the Malindi order on LR No. 13061. A ruling by the Malindi court itself, an appeal that is filed but not decided, or a statement by the government resolves NO.
We looked for cases where people living on the land for a big project backed by their government went to court, asked for their land rights to be settled before work began, and got a court order to leave the land as it was until a hearing. We found eight, from 2001 to 2024. In seven, the order was still in place 19 days after it was made, the same gap as between the Lamu order and the 14 October hearing. Only two of the eight are from Kenya, and four are from Mexico.
