Resolved: NO

The Commission press corner and home-affairs news carry no EES derogation or new enforcement date by 14 October 2026, and the Independent reported that day that Abta was still asking the Commission to bring forward legislation, so only informal tolerance exists.

How this resolves

Resolves YES if, by 23:59 CET on 14 October 2026, the European Commission publishes at ec.europa.eu/commission/presscorner, home-affairs.ec.europa.eu or travel-europe.europa.eu a press release, decision or notice that extends the period in which member states may suspend EES biometric registration or sets a new enforcement date, while informal tolerance reported by the press, spokesperson lines and member-state statements resolve NO. If those pages are unreachable, BBC News and the Guardian reporting the text settle it, and silence on all of them by the deadline resolves NO.

The pattern behind it

1 of 6
One of the last six not-ready signals on an EU border system drew a formal new date within 30 days, eu-LISA's January 2023 minute. The five since 2024, Dover and ETIAS among them, drew silence, a refusal or a pointer to old rules.

Only one of six recent warnings got a new date in writing. We looked at every public warning since 2023 that an EU border system would miss its start date. The warnings came from member states, from eu-LISA, the EU agency that runs the systems, and from airlines and airports. We checked whether the Commission or eu-LISA put a new start date, an extension or an exception in writing within 30 days. The newest cases come first.
