How this resolves

The market resolves on the case page at gov.uk/cma-cases/eon-slash-ovo-merger-inquiry, updated on the day of decision. YES if the CMA publishes a reference decision under section 33 of the Enterprise Act 2002 referring the merger for a Phase 2 investigation on or before 28 October 2026; a Phase 1 clearance, or undertakings in lieu of reference accepted by the CMA, resolves NO. If that source has not published in time, Reuters and BBC News reports of the decision settle it.

The pattern behind it

Too few cases
Four of the five household supply mergers on the CMA case finder cleared at Phase 1: SSE and Atlantic (2004), npower and Telecom Plus (2006), Telecom Plus and npower (2013) and OVO and SSE Retail (2019). SSE Retail and npower (2018) went to Phase 2 and took eight months. Five cases is the full record and below the six Hunch requires to show History, so the count is given as context, not as a chart.

Four of five past mergers cleared at the first stage. We looked at every merger decision on the CMA's records since 2003 where a supplier of gas or electricity to homes in Great Britain sold that business or its customers. We asked one thing: was the deal cleared at the first stage, or sent to a full inquiry? Deals about networks, power stations or business customers are left out.
